Starting August 17, 2024, the real estate industry will undergo significant changes due to the National Association of Realtors (NAR) lawsuit settlement. Here’s a straightforward breakdown:
1. Commission Transparency: Real estate commissions will be more transparent, allowing buyers and sellers to see exactly what they are paying for and to negotiate these fees more effectively.
2. No More MLS Compensation Offers: MLS listings will no longer show offers of compensation to buyer brokers. Instead, compensation must be negotiated directly between the parties.
3. Buyer Agent Fees: Buyers might need to pay their agent’s commission, which used to be covered by sellers. This could increase the cost for buyers.
4. MLS Participant Definition: The new rules focus on the obligation to share property information and cooperate, without mentioning compensation offers.
Buyers :
- Prepare for Extra Costs: Buyers might need to cover their agent’s fees, so they should factor this into their budget and negotiate these costs upfront.
- Better Understanding: The changes will provide buyers with a clearer picture of what they’re paying for, making it easier to evaluate the value of their agent’s services.
Sellers:
- Potential Savings: Sellers might save money if buyers cover their agent’s fees. However, this could make selling harder if buyers are hesitant about the extra costs.
- Be Ready to Negotiate: Sellers should be prepared to discuss compensation terms with buyers and their agents.
